from every indication i've gotten, the flaming lips allow taping. i'm not sure that this is always translated clearly to the venues. i've seen/taped the lips on several occasions, but i've also been unable to tape on other occasions. it can be pretty frustrating at times when you don't know what you're going to run into when you get to the shows.

Exactly - ultimately it's always gonna be the venue's call, but so far it looks like 80/35 is ok as long as it's just audio. I make little videos w/ my digital camera, but usually when I'm in front the security will see (I guess watching for the fact that my finger doesn't keep hitting the shutter button..? don't know) and tell me to quit.

actually, to clarify, the problem i've run into (and i've run into this with other bands) is the venue not being properly informed of what the policy actually is. i personally have never been to a venue that completely prohibits taping (though i know there ARE some out there (but i'd wager they're in the minority) -- most enforce whatever policy they have been told, and i would say a lot of them that don't get specific information, automatically assume it's a no-go.
